IMPROPER SERVICE OF SUMMONS AND COMPLAINT - If you were not properly served with the Summons and Complaint in a lawsuit filed against your business or you, we can help.  Improper service of summons and complaints is a growing problem and you do not have to navigate righting the wrong alone.  Sadly, California law is not rigid regarding personal service requirements.  Plaintiffs had problems personally serving defendants and California Courts could not obtain personal jurisdiction over defendants for lawsuits to move forward.  New forms of service were created loosening the rigid service requirements.  This was the beginning of the end to ensuring no fraudulent default judgments were entered against a human with no idea they were served or even sued in the first place.  Instead of making plaintiffs meet the rigid requirements for personal service so all parties KNOW the defendant was actually personally and KNOW the California Court has personal jurisdiction of the defendant to enter judgment the legislature loosened the requirements pandering to the lowest common denominator.  This how all of our society has declined.  How about making the personal service requirements more rigid to make sure no human has a default judgment entered against them without their knowledge again?  That sounds good and good for every other human too.  It must be right then.

Evidence of "actual delivery" of the summons and complaint upon the person to be served is enough is support properly.  Alternate forms of personal service were created such as substitute service and service by publication.  Substitute service and service by publication must make certain assumptions that the defendant was "actually" given the summons and complaint or read the publication or was informed of the publication of the lawsuit to provide notice.
